Black Hawk County (hereinafter referred to as BHC) Geographic Information Systems (hereinafter referred to as GIS) data and data products distributed by the Information Technology Department contain information from publicly available sources. BHC developed the data for internal use. All data is provided as is, with all faults, and without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. 2. BHC is not responsible for any hardware or software needed to access and use the products and information therein. 3. Any entity or party using this data understands and acknowledges that the products and information contained therein are subject to constant change and that accuracy of the data cannot be guaranteed. BHC makes no warranties or guarantees, either expressed or implied, as to the completeness, accuracy, or correctness of such data or data products, nor accepts any liability arising from any incorrect, incomplete or misleading information contained therein. 4. BHC shall not be subject to liability for human errors, defect or failure of machines, or any material used in connection with machines, including but not limited to tapes, disks and energy. 5. Any entity or party using the data releases BHC and its officers, agents, consultants, contractors and employees from any and all claims, actions or causes of action for damages, including, but not limited to, any costs of recovering, reprogramming or reproducing any programs or data stored in or used with the BHC GIS data, damage to property, damages for personal injury or for any lost profits, lost savings or other special incidental or consequential damages arising from the use of or inability to use the BHC GIS data. 8. Any entity or party using the data shall indemnify and hold harmless BHC and its officers, agents, consultants, contractors and employees from any and all liability claims or damages to any person or property arising from or connected with the use of BHC GIS data.

Use_Constraints:

Restrictions On Use 1. Black Hawk County (hereinafter referred to as BHC) GIS data and data products are provided as a one-time delivery. BHC has no responsibility for updating this data or data product, such as a CD or tape. 2. The use or purchase of BHC GIS data by an entity or party does not constitute a sale of any title or interest in the BHC GIS data or data products. 3. Any entity or party using this data agrees to recognize and honor in perpetuity the copyrights, and other proprietary claims for databases, tax maps, and other collateral information, and products established or produced by BHC or the vendors furnishing said items to BHC. 4. Copies Any entity or party using this data may copy BHC GIS digital data only for backup purposes and not for use by any party beyond that to which the data was directly delivered. 5. Derived Products Graphic displays and printed tabular listings derived from BHC GIS data may be used in publications and presentations, provided that credit is given to BHC as the custodian of the data and credit is also given to the original source of the data if other than BHC. 6. The BHC GIS digital data are for the internal use solely and exclusively by the entity or party to whom BHC delivers the data. The data should not be used by anyone beyond the original entity or party to which the data was delivered, unless specified at the time of data distribution. 7. The entity or party to which the data was delivered shall not license, assign, release, transfer, sell or otherwise make available the BHC digital GIS data, data products or portion thereof to a third party without the expressed written permission of BHC. 8. Upon the occurrence of the breach of or non-compliance with any term or provision above, BHC may provide written notice of the occurrence to the data user. Any agreement for data use shall terminate 60 days following such notice. The data user shall, within 30 day after termination of an agreement, return to BHC all GIS data and data products that were exchanged through any data distribution agreement with BHC. 9. All data distribution and related agreement and performance hereunder shall be governed and construed by the laws of the State of Iowa.

Diazo proof plots were generated by the Sidwell Company. Staff from the Auditor's Office, Assessor's Office and Management Information Services verified the accuracy of attribute linkages between database and graphic elements.

Land features of this cadastral GIS are spatially referenced to the correct position on the ground through the use of digital orthophotos. The digital orthophotos were developed based on 179 measured ground control points. These measured points fall within +/- 0.05 meters in horizontal position, using a 95% confidence factor. All georeferenced entities carry an accuracy of +/- 0.05 m, using a 95% confidence factor, when measured against the assumed accuracy of the digital orthophotography from which it was created. These accuracies must be measured against the relative accuracies of the disparate source documents (recorded plats, tax roll descriptions and existing paper parcel maps) and the positional decisions that were made based on the preponderance of available evidence on a case by case basis. Users should be aware that even though the scale of digital data may be increased to overlay large scale digital maps, the accuracy of the digital source is not improved by scale enlargement.
