Black Hawk County Policy on the Application of Fugitive Dust Control Agents
STATEMENT OF POLICY
It shall be the policy of Black Hawk County to allow private and/or commercial application of various fugitive dust control agents to the unpaved secondary roads under the jurisdiction of the Black Hawk County Engineer.
A permit is required pursuant to the provisions of Chapter 319.14 of the Code of Iowa (Obstructions in Highways).
Permit applicants assume the full responsibility for and any liability resulting from this work on a public roadway.
IMPLEMENTATION OF POLICY
Persons desiring to apply these agents shall contact an approved applicator prior to April 15th.
By April 15th the applicator shall provide the County with a list of locations where dust control has been requested for the season. The list shall provide the resident’s name, address, agent to be use, and length of requested application.
The applicator shall provide the County with a current Material Safety Data Sheet (MSDS) for the material to be applied.
The applicator shall provide the County with a Certificate of Insurance conforming to the County’s requirements. A statement of the current requirements is available from the County Engineer’s Office.
The applicator shall provide proper traffic control and signing during and after the application as specified in Attachment #1.
Application of dust suppressant is not allowed on Sundays, Holidays, or between sunset and sunrise.
Upon the County Engineer’s approval the County will issue a permit to the resident who has requested application of an approved dust control agent.
All financial obligation for the cost of dust control is between the resident and the applicator.
Roadbeds will be prepared for dust control by May 15th unless extreme weather, wetness, or frost conditions make this impossible. In that case the county will notify the applicator.
Maintenance Operators are to avoid blading treated sections of road for as long as the road remains in good condition. In many cases dust control can be left undisturbed for the season providing the resident fills any potholes that develop with loose rock from the road. However, if potholes or other deterioration of the treated area reaches the point of being an immediate hazard to traffic, the County, upon the order of the County Engineer or Road Superintendent, will blade and repair the treated area without notice or compensation to the resident. Repair by the county will consist of scarifying the treated area and maintaining it as a granular surfaced road. Maintenance Operators will blade treated sections if they become slippery.
After October 1st the County will resume regular rock road maintenance on treated areas as deemed to be in the best interest of public travel. If a chip seal treated area is determined to be in good enough condition it will not be bladed.
DUST SUPPRESANT MATERIALS
CRANK CASE OILS -Not allowed, reference Federal Register 9/10/92
NEW OIL AND CUTBACKS - Approval must be obtained from the County Engineer prior to application.
The applicator shall provide and place “Fresh Oil” (W-21-2) signs prior to application (see Attachment #1 -Figures 1 and 2). The signs shall remain until tires no longer pick up the oil.
LIGNON SULFONATE (TREE SAP)
The applicator shall provide and place “Fresh Oil” (W-21-2) signs prior to application (see Attachment #1 -Figures 1 and 2). The signs shall remain until tires no longer pick up the sap.
CALCIUM CHLORIDE
The applicator shall provide and place “Fresh Oil” (W-21-2) signs prior to application. Place signs as shown on Attachment #1 - Figures 3 and 4. A yellow diamond sign or other marker should be left in place for the season to show the maintainer operator where dust control has been placed.
BITUMINOUS OILS, MC-70 & OTHER CHIP SEALS
Approval must be obtained from the County Engineer prior to all applications. Sand and chip cover aggregate are required when bituminous oils are used. Prior to application of oil the applicator shall provide and place “Fresh Oil” signs (W-21-2) as shown on Attachment #1 - Figures 1 and 2. The signs shall remain until tires are not picking up the coating.

DUST SUPPRESSANT APPLICATION IN BLACK HAWK COUNTY
THE APPLICATOR
Provide the County with a list of locations where dust control has been requested for the season. The list shall provide the resident's name, address, agent to be use, and length of application. The county should receive this list no later than April 15th.
Provide the County with current MSDS sheet for the material to be applied.
Provide the County with a conforming Certificate of Insurance.
Provide proper traffic control and signing during and after the application. If you are uncertain about what is necessary, please call this office. Application is not allowed on Sundays, Holidays, or between sunset and sunrise.
THE COUNTY
Issue permit to resident to have dust control applied as requested.
Prepare the roadbed at the listed addresses by May 15th . If this will not be possible due to extreme weather, wetness, or frost conditions the county will notify the applicator. The County will not be responsible for re-working treated areas if dust suppressant is applied prior to the County' s roadbed preparation.
The County will avoid blading treated sections prior to October 1st unless potholes develop or roads become slippery.
If potholes or other deterioration of the treated area reaches the point of being an immediate hazard to traffic the County will resume regular rock road maintenance on treated areas as deemed to be in the best interest of public travel.
The County will re-work the roadbed after October 1st, excepting chip-sealed locations in good condition.
THE RESIDENT
Sign up with the applicator of your choice before April 15th.
Resident is responsible for all payments to the applicator.
Resident should fill potholes that develop with loose rock from the road. If the resident does not fill the potholes the County will blade the road to proper crown and grade when condition warrants. In that case, the County will not wait until October 1st to re-work the roadbed.
If a chip-seal has been applied and the road condition is still good, the County will not re-work the dust control until you request another application of chip-seal or the road becomes too rough.
